Why Contracts and Service Agreements Matter

Whether you are working as a nanny, maternity nurse or companion carer, it is essential that clear terms are agreed before any employment or assignment begins.

If you are employed by a family as a nanny, your employer should provide you with a contract of employment. This document sets out your duties, hours of work, rate of pay, holiday entitlement, notice periods and other employment conditions. A written contract helps to avoid misunderstandings and provides protection for both employer and employee. If a contract is not provided, it is important to request one. Knowing exactly what is expected of you, and what you can expect in return, helps to establish a positive and professional working relationship.

For those working as self-employed maternity nurses or companion carers, the situation is different. As you are likely to provide services to a number of clients rather than working exclusively for one employer, you would not normally receive a contract of employment. However, this does not mean that written agreements are unnecessary.

A professional Service Agreement is equally important for self-employed practitioners. This document clearly outlines the services you will provide, your fees, payment terms, cancellation policies, responsibilities and expectations. It gives clients a clear understanding of what they are purchasing and provides reassurance that you operate as a professional business. At the same time, it protects you by ensuring that there is a mutual understanding of the service being delivered.

When both parties know exactly what is expected, it creates confidence, reduces disputes and helps build a successful working relationship. It is very much a win-win situation for everyone involved.

At Project Action London, we have supported childcare and care professionals for many years through our consultancy and vetting services. As part of this support, we help practitioners ensure that all aspects of their professional arrangements are in place, including service agreements, references, DBS checks, first aid certification, insurance requirements and other areas associated with working as a self-employed professional. Our aim is to help individuals work safely, professionally and confidently while providing clients with peace of mind that they are engaging a suitably vetted and qualified practitioner.

Having the correct documentation in place from the outset is not simply about paperwork. It demonstrates professionalism, protects all parties involved and helps create the foundations for a successful working relationship.
